Department of Real Estate (DRE) Process
A developer of a subdivision, Planned Unit Development (PUD), or a condominium project more than four units must submit their plans and permits to the DRE. The following tasks are required to complete a DRE approval process before sales of the units can occur:
1. Hire a Real Estate Attorney to do the following: Articles of Incorporation, write the CC&R’s, write the By Laws.
2. Hire a DRE Application Consultant
3. HOA Budget Preparation
4. Submit Notice of Intention to DRE
5. Prepare Application for Minimum Filing Package, including:
a. Prepare Civil Drawings, Plot Plans
b. Prepare full set of drawings and submit for reference
c. Tentative Map
d. Phasing Plan, list of units
e. RE Form 624A: Common Facilities for the HOA
f. RE Form 623: HOA Budget
g. Financial Arrangement to assure completion of common facilities
h. Receive Conditional Approval from City and/or County
i. Preliminary Title Report
j. Water Company approval
k. Flood Report
l. Schools Report
m. Sample Grant Deed
n. Escrow Instructions
o. Common Area Conveyance
p. Subordination
6. Submit Application
7. Substantially Complete Package and Application
8. Final Public Report Process Begins
9. Receive Conditional Report
10. Qualitative Deficiency Notices for corrections and additions to the package
11. Budget Deficiency Notices for errors to the budget
12. Obtain Bonds for: Common Area Construction, Public Works Construction, Street Improvements, Substantial Completion.
13. Record Final Map
14. Receive Title Report
15. Receive Title Insurance
16. Obtain new APN numbers
17. Receive Original of the Public Report
18. Provide copies to buyers and take receipts
19. Return the original and two copies to the DRE
20. Developer hold copies of receipts for buyers for three years
